Telephone Account Wagering Information

RULES FOR THE OHIO TELEPHONE ACCOUNT WAGERING SYSTEM

A person must be 18 years old to open an account. Proper identification shall be required to open an account, with a minimum deposit of $10.00. Amount requirements may be changed at the discretion of OHIO TAB.

Rules of the Ohio Racing Commission for wagering are in effect for the telephone account wagering system.

All wagers shall be placed in U.S. currency.

Wagers will only be accepted from accounts with adequate balance to purchase such wager(s).

All wagering conversations will be recorded and such recording shall be available for 30 calendar days or whatever time period required by the Ohio Racing Commission. Claims of discrepancies will not be considered after such time.

At the time of application, a computer generated account number will be assigned to the applicant’s account. The applicant shall select a secret pass code at the time of the application. Either the account number or pass code can be changed at any time by OHIO TAB provided the account holder is notified in writing. The account holder can request a change to the pass code with the approval of OHIO TAB. Inappropriate codes can be disapproved at the discretion of OHIO TAB.

Accounts will only be established in an individual’s name. No corporation, partnership, joint trust, beneficiary or custodial accounts will be established. The account is nontransferable.

OHIO TAB reserves the right to refuse to open an account for any reason and may suspend or close any account for any reason provided such credits in the account entitled to the holder be forwarded to the address provided by the account holder.

In the event of the death of an account holder, the account credit shall be released to the decedent’s legal representative only upon the presentation of such documents as required by OHIO TAB.

OHIO TAB reserves the right to refuse any deposit to any account for any reason.

Any change of address notification is the responsibility of the account holder and any correspondences not received by the account holder will not be the responsibility of OHIO TAB.

Account wagering shall be accepted during such times and days as designated by OHIO TAB.

All tax liabilities shall be the sole responsibility of the account holder.

Deposits to and withdrawals from existing accounts shall be permitted only in the manner prescribed by OHIO TAB. Deposits and withdrawals shall only be permitted during such times and such days as defined by OHIO TAB.

Checks offered for deposit in a deposit account shall not be credited to the account until the check has cleared the bank. (5 BANKING DAYS)

Signed withdrawal requests will be honored only after the account holder’s signature is verified. Requests will be returned to the address on file for such account in the form of a check.

Notwithstanding any other rules, the person in charge of the account wagering center may, at any time, declare the facility closed for receipt of any or all wagers.

OHIO TAB has the right at any time and for any reason to refuse to accept all or part of any bet.

All wagers are regarded as final after the account holder accepts the wager and the transaction has been completed.

The account holder bears full responsibility for maintaining the secrecy of their account number and pass code. No one associated with OHIO TAB shall be responsible in any way for any funds lost due to the improper use of any account by an unauthorized individual.

The account wagering telephone number(s) shall be kept confidential by the account holder and are to be used only by account holders.

Payment of winning pari-mutuel results shall be posted to the account as soon as possible after the results have been declared official.

OHIO TAB shall make available upon written request by an account holder an annual statement of their activity. Such statements will be considered correct unless written notice is received within 21 days of postmarked correspondence.

Any unresolved dispute concerning a final determination by OHIO TAB regarding the balance or any other aspect of an account may be referred to the Ohio Racing Commission within 30 days of determination. Disputed claims beyond this time will not be considered.

Any person who, with intent to obtain, or enable themselves or any other person to obtain, any payment to which they are not lawfully entitled, or attempt to alter, change or interfere with any equipment or device used in connection with OHIO TAB, or cause any false, inaccurate or unauthorized information , data, impulse or signal to be fed into, or transmitted over, or registered in or displayed upon such equipment or device, shall be guilty of a class D felony.

The above rules shall apply unless changed or amended by OHIO TAB as authorized by the Ohio Racing Commission.

Determination by OHIO TAB as to disputed betting errors shall be final and not subject to further legal action.

All winning wagers are subject to all rules and regulations of the Internal Revenue Service.

 

TAB TELEPHONE OPERATOR CONVERSATION

Operator: "Hello, this is the OHIO TAB and I am operator number _______. May I have your account number?"
Customer: gives account number.
Operator: opens account.
Operator: "Password?"
Customer: gives password.
Operator: verifies password and states, "Your current balance is $_______."
Operator: asks customer, "What is your bet today, and at what race track?"
Customer: speaks their track and wager, "race, amount, bet type and horse(s)."
Operator: repeats back to the customer, "track, race, amount, bet type and horse(s) including names(s) of horses" and asks if the customer accepts the wager. If the customer does not accept the wager, the operator either corrects the wager or does not "sell" it. If the customer accepts the wager, the operator "sells" the wager and the system debits the account, the operator then again speaks the new current balance.
Operator: then asks if the customer would like to place another bet, if they do, the customer speaks their new wager. If they do not, the operator will thank them and cordially end the call. The operator closes the account, releases the telephone line and waits for the next call

All wagering conversations are recorded and are available for 30 days for review.
